Action Item: Demolition of a Structure of Varying Ages in the Demolition Delay Overlay Zone and within the Lower Village Historic District, 19 Spring Street, Map 33 Lot 109, Ryan and Brittany Peters, Applicant.
The applicant is proposing to demolish the structures at 19 Spring Street (Map 33 Lot
109) due to the presence of mold, asbestos and structural conditions of the building.
The northern portion of the structure is more than 75 years old, whereas the rest of
the structure and the sheds on the property are less than 75 years old. The structure
is listed as a Contributing Structure for its prior commercial use as a market, which is
only evident in the interior features not under the jurisdiction of the ordinance. As the
building is within the Demolition Delay Overlay Zone and Lower Village Historic
District, the applicant is requesting review to determine if the structure is a Building of
Value under Chapter 701, Article IX. It is defined as a building that has architectural,
cultural, historical, or archaeological significance, contribution to an overall setting
or streetscape, or otherwise of a character defining a particular area,
neighborhood, or streetscape.
If the Board determines the structure is a Buildings of Value, the Board may apply a
delay of 180 days to undertake efforts to modify the design to retain and respect
the significant character defining features of the building and/or other efforts
outlined in Chapter 701, Article IX. The Board may also waive any delay if it
determines that the proposed design retains and respects the significant character
defining features of the building. If the Board determines that it is not a Building of
Value, the alterations may proceed after a 30-day appeal period. The Board is
scheduled to vote on this item after public comment is received.
